Good news from Ministry of Labour Dubai
Saturday, July 25, 2009For the past weeks, I wasn’t able to post events on my blog, due to the problem I’m facing with the company I’m working with. Even my own weding was washed out of posting because of this. This day, when I arrived at the office, Kuya gave me this link to read. It states about having no ban for 6 months, no need to get an NOC from your company, and its your option to continue to work or leave your company IF YOU HAVENT PAID FOR MORE THAN 2 MONTHS. The salary injustices is very critical in Dubai and needs urgent attention. I applaud the Ministry for protecting the people and not the big headed company owners. The statement is copied from the link.
Dubai: Any worker who has not been paid for more than two months has the right to change jobs without a No-Objection Certificate (NOC) even after receiving his dues, a senior official at the Ministry of Labour said on Thursday. “The rule is also applicable to those who have not been paid for the same duration of time but decided to cancel their work permits where they will have the six month ban, which is usually enforced by the ministry, lifted.” The worker has the right to leave his employer without filing the required notice period if the company does not fulfil any of its commitments as stipulated in the employment contract.

Hi Atif thanks for visiting my blog. How can they say that your employment visa is expired when they just recently applied for it? For all I know, an employment visa can never be expired not unless you have termed your contract nor canceled without your signature. Anyway, since you are on that situation, all I can advise is to call a friend/family that is working in Dubai (since you are in Pakistan) to look for a PRO that can assist you in canceling that EV. Don’t wait for your company to cancel the expired visa coz they will spend money in doing so and what will they get in return? Nothing. Actually, if they submitted an application for your EV while you’re at VV, before the VV expires, the company can give you option to go exit for a day or two or for them to pay the charges so you will not exit anymore. What happened to your case maybe was they submitted the papers for EV processing, but in the end they decided not to pursue you anymore and the EV was expired, so they let you exit in Pakistan. Greedy company. Lets hope for the best, next time. Or ask assistance from your consulate.

I lose my job 13 days before my 2nd anniversary in the company and I have a limited contract for 2 years, am I entitled for the 3 months pay benefits as per UAE labour law + gratuity + leave balance, even the reason for terminating the contract is because of recession?

If the date you signed the contract is the same as in your Pataka, UAE labour will not honor ALL the benefits. Labour will tell you to speak to your company about getting your other benefits. Let’s say in your company contract, it will end on December 5, 2009 but in your Pataka it will end on January 10, 2010. What Labour will check is the one from your Pataka, not from your company contract. Moreover, companies in Dubai is using the word worldwide recession to decrease their employees who will gain all the benefits after they termed their contract (as what supposedly will happen to you), you know for them not to give anything. And under Law, if the company tells you that that is the reason why they terminates you, it becomes valid. Just like a company who became bankrupt and lost all their assets and can’t give anything back to their employees, this is valid. Employees can’t do anything about their pending salaries and benefits. In the end, it is still best if you check with the Labour Dept (800-665) on what other options you have and return here to update me. Thanks and goodluck.

How much of this is true. I heard a lot about lifting the ban if the company does not pay. I am dealing with the Dubai court as the company does not wish to pay. But I dont know how this situation of ban lifted?! Do i need to have a job offer to be lifted. I have been working for 11 months of an Unlimited contract. besides the company did not pay me for 2 months & 26 days. Did anyone had the same issue and the ministry lifted his or her ban, please update me or drop me a line. Thank you.
Hi Mahmoud, since you’re dealing with Dubai court, they can help you enlighten on what may happen in lifting your ban. Since according to this article, as far as 2 months that the company is not giving salaries is concerned, no need to furnish an NOC from them, your new company shall not acquire this from you either. As long as you were able to give your new company proof that you’re not being paid and/or Dubai court ordered or stamped your passport maybe, that you don’t need any NOC. I don’t know the procedure, and I hope you can give me feedback too since you’re already with Dubai court. If you are not paid for 2 months and 26 days, as of writing, I am not paid for 3 months (Sept-Nov) + 7 days of December 2009. Before, I contacted the Labour Dept about Internet Heroes not giving salaries, but the company was able to get out of the situation and they are still operating up to this day. We hope that everything will be better sooner than what we expected. Just hang on and don’t loose hope.

A Pataka is only a residence visa and will not qualify as an insurance if something happens to your brother. Since your brother worked for almost 3 years, within those years, I hope your brother was able to file a “certifiate of something” given to OFW from OWWA or PULOWWA office in Dubai. This will guarantee that a Filipino is working abroad legally and an OFW can get something out of it including medical assistance and so forth. Since your brother is dead, his beneficiary should get something. I hope this information helped your family. A lot of Filipinos are needed in Jordan this end of the year as I heard, to all Kabayan, take a milestone of care.

Posted by lady at January 20, 2010, 8:48 amHi Lady, I went through the same situation before where i joined the company November and my internal contract says for 2 years but they applied for my pataka and it starts February the following year and its good for 3 years. Am asking is if you have the same situation, if it does, its better to ask for release from your company before february, amicably ask for their release without the authorities knowing it. the thing is Labour will honour what is in the labour contract and not what is in internal contract. with that said, if you go to the correct process, you have to wait for february so that your company will give you what is ought for you.

Posted by jasmin at January 25, 2010, 9:25 pmHi Jasmin, if in your contract it says to give 30 days notice to the company before resigning, it would be best to give your resignation letter now and wait for 30 days. At least you followed your company rules, and in that situation you can ask them very friendly about your noc. Since you are one year in March, you might be getting your yearly bonus also, speak with your supervisors about it. With NOC, it’s an option of the company if it will be given to the employees, and authorities (from Labour) cant give command to the company to give noc to their employees if you plan to seek assistance from Labour Dept. So for your last days, it would be best if you are friendly to all so they can give you your noc. Good luck!

I resigned from my current position as Store Manager here in Dubai and the reason I had given was Im leaving the country, which is the original plan, but I found a much better job, same position, but different field so I decided to stay. My contract is unlimited and the company just renewed it for the 2nd time last July 2009. My visa is yet to be cancelled. Will there be any issues if I will transfer my visa to other company even I have given them different reason of leaving the country?? The thing is that they only give the passport an hour or two in the airport before the scheduled flight. Anyone, please help..
Posted by titin at January 31, 2010, 6:33 amHi Titin, it doesn’t really matter how long you stayed in the company for them to give you NOC, it is their discretion if they will give you or not. If you told them that you’re leaving UAE, why do you seek NOC? Better ask for your employment certificate or experience letter. If you will talk to them in a nice way and tell them that the reason why you will resign is you found a better opportunity for your career advancement and your future company is not a competitor of your current company, moreover tell them that you will bear the fees that they encountered when they renewed your visa by the help of the future company, they might give you an NOC. If they will not give you NOC after you talk to them in a positive way, wait for them to give you your passport at the airport but you will not get NOC. Exit to other country and tell your future company to give you an employment visa while you’re in Exit. Or tell Labour that your company is not giving you your passport, because it is illegal for the company to keep the passport of their employees. Hope it helps..

Hi Ann, are you in a situation where your company let you start with internal contract while they process your labour card, or are you in the situation where they dont let you start unless they have processed your papers to labour dept? The reason I ask is there are strict companies that they wont allow employees to start not unless everything is processed, not unlike many of the companies in Dubai that they use the visit visa and they let the person start before they will acquire employment visa. They take advantage of your visit visa. I think you are in the first situation. All your company need to do is to cancel the processing of your visa but you will pay for the fees to cancel it. Resign, talk to them that what you are getting is not what they told you to give during interview. No need to get any NOC from your company coz you can get NOC from your husband. Im positive even that they havent applied for the cancellation of your husband visa to be transferred to employment visa. Talk to them nicely. And labour card comes after medicals. So it isnt labour card that they will cancel, its the transfer of your husband to employment visa.

On that day he send me home and told me that he will call me if he needs me. it’s been a week now and yet im not allowed to come back to my work, without any paper or memos from them. is this legal? couple of days ago he ask me to go to the office for the investigation, and ask me not only the coco bar thing!
i need your immdiate advice, i even ask him after the investigation if i am suspended or terminated. he didn’t answer.
Posted by gi joe at February 8, 2010, 3:18 pmHi gi joe, your gm has a way of removing his people huh!? talk to your supervisor about it if you’re not reporting directly to your gm. since there are no papers that came from the upper management for you to take absent, why will you be absent? always bear in mind that merely saying anything is not a good evidence, it has to be written in black and white. Meaning, what is your gm’s evidence/reason for not sending you to work, in the contrary if accounts will check your attendance, its not your gm who will answer why you’re absent. you cant just tell accounts that your gm stopped you from going back to work without any piece of evidence your handling. if there are investigations and you’re part of it, at least they should have given you notice for not coming to work while the investigation is still in progress.

Hi Ann, if I’m not mistaken, if you’re under probationary period, it’s no use to serve them a month, right there and then, you can move out. Usually the 30 days grace period is for those who passed the probationary period. But since you have a labour card, it would still best to ask your HR, with regards to how long it would take for your visa to be cancelled, it would take 5 minutes only, usually it would depend on how fast your PRO will take actions. Posted by jasmin at February 9, 2010, 8:11 pmHi Jasmine, if you get a freezone company, whether you’re banned by your previous company and whether you have an NOC or not, freezone wont care a thing. no need for you to exit or return to your home country, I am the living proof of not going through exit/return home when I found a job inside freezone within a month. You have 1 month stay in UAE after resignation, so you still have time to look for another job, your company has no right to send you back immediately because they didn’t terminate you in the first place, its you who resigned. Caution: not all companies within freezone area are a freezone company. The company name should have FZE or FZ at the end of it, alright!

Posted by Lala at February 10, 2010, 1:52 amHi Lala, there are 2 types of ban, labour ban and immigration ban. if you will pay for it (or your next company), its the labour ban that you’re lifting. Usually, they are both for 6 months, sometimes you’ll hear im ban for 6 months, meaning you can join another company but without labour card and future company can apply for that after 6 months only, or when you pay for it. Current company has the authority whether or not they will give you NOC, not even Labour can force the company to give you one. The reason they gave NOC is current company allows their employees to join other company after resignation. Most of the time, if you have NOC, you don’t have ban. If you don’t have NOC, you’re banned.

I am employed in a company here in Dubai for already three and a half years and didn’t receive my salary for the past 3 months, as of end of January 2010. I submitted an immediate resignation on the first day of this month and after 3 days they gave us one month salary, still they owe us two. The reason why I resigned was I need to take all my dues in the company in order to support my mom back home who will undergo operation in next few days. Now my resignation is effective today, Feb 11, and I just got an info from the company that they will not give me my dues. I asked them if when they can give it because my mom needs to undergo such treatment but they only answered me “We don’t know”. Now I’m stuck and don’t know what to do. Can you please share some advices on how will I obtain my money as soon as possible. Thank you in advance?
Posted by JoseQ at February 11, 2010, 3:29 pmHi JoseQ, I was in a similar situation, where I didn’t receive any salary for 3 months and so I gave my resignation, and told the company that I can’t come to work anymore because I dont have money (and there I have time for interviews). You need the money whatever it takes, bring your case to Labour dept, and Labour will take care of your dues. Do not sign anything from the company about canceling your visa yet, because there is a sentence in the cancellation of the visa that the company paid the employee all dues. For my case I should have gone through the Labour dept coz I have previous cases with the same company for same reasons (from June to December 2009 I have complaints filed with Labour, sometimes my company give salary and its late, sometimes they dont). I opt not to go to Labour anymore coz my next company is asking me to be with them immediately and so I need papers/documentation for cancellation and processing of visa. If I had time, I will go to Labour, on your case weigh the pro’s and con’s of going to Labour or merely trusting your company to give your dues (like me, I’m still waiting for the last month they owe me until now but at least I got another job to compensate for the loss). I gave my resignation to my company and it will be effective on March 5. One of the owner took my Labour Card eventhough its still Feb. 15 and i still have 15 days left on before my last day. My question is, Are they(company) allowed to take my labour card eventhough im still working for them.can they cancel my visa without any paper that i need to sign? Posted by Mar at February 16, 2010, 7:17 amHi Mar, your company shouldn’t have done that (getting your labour card until March 5, and until they have canceled your visa. If you surrender your labour card, you should have your passport returned to you, and the reason why you will sign for the cancellation of your visa is because your company have given all your dues back (it is stated on the cancellation paper). And it’s unlawful for them to cancel your visa without your signature, they will be forging the document. Now if you bridged the contract (I assume yes since most of the contracts here are 3 yrs), and you are banned for 6 months, you are still entitled for a month’s stay here in Dubai, once you exit that’s the time UAE will impose the 6months ban.Not unless you get a free zone company that will negate your ban. For more help regarding your rights, check with your embassy, always.

Posted by suresh at February 22, 2010, 11:24 pmHi Suresh, 1. you can look get out of the company since you're stilll in the probationary period (check with your company how long it will be, usually 6 months) and within those months, you can resign or the company can terminate your contract. It's just that if you resign, your company might not give you an NOC and they might ban you for 6 months. 2. That's the solution, approach them very nicely, don't argue. 3.That's possible if they didn't give you bans. I hope you'll get what you're looking for. Thanks for visiting.

I just want to ask if I am entitled to receive end of service gratuity and a return ticket to my home country, my employer is telling that I will not be receiving these benefits because I resigned. Is it correct? Please make this matter clear to me because I am a bit confuse. Thank you.

Like for example ban for 6 months if you resigned. Set yourself if the job being offered is what you want and will nourish your experience so you can stay with them for 2 years. Good luck!

It’s like telling them in advance not to renew your contract after February 2010. Your company is just telling you bulls so they wont give any dues. If you resigned last October 2009 and gave them a grace period, I can understand your company for not giving you your rights, because you resigned (you didn’t finish the contract). But for giving resignation letter and there comes a mutual agreement for you to finish your contract, that is already an evidence that you finished your contract. Is your mutual agreement documented? If not, make sure that you are receiving your salary slip for months of Oct2009-present, just in case you will file complaint against them. shuwada!

As you know all my history ,I Joined one company in Dubai and I am on my husband sponsership.
I resiged within a month because of some personal reason,and it was mention in the contarct that I have to serve the 1 month notice period and i was ready to serve the notice period but they relieved me in 15days ,they have given me the relieving letter.
now my problem is:
1)I have allready recieved the offer letter from another company.
1)My labour card is already issued by the last company
2)Now last company is giving my labor card for cancellation but company is saying that I will have 6 months labor ban or 3 yrs fine because its written in the Labour card cancellation form and if I will apply for other company they wont be able to issue my new card either new company has to pay my labour ban amount.
my last company is also saying this ban is automatic ban from labour department company is not involve in this.
now I want to know that is it true that even if I am on my husband sponsership I will have labor ban?or I have to pay sm amount to Labor Department for new job?I checked with Ministry of labor UAE ,they said I will not have any ban if I am on my husband Sponsership.and the Labour card Cancellation form is same for all so its just written their that there is 6 month ban .Its not aplicable for my case.Is it true?

Hi Ann, Labour Dept is correct, it’s not applicable to your case. The reason is simple. Your last company is not your sponsor; your sponsor is your husband. Your husband can issue NOC to you if your new company requires it. Not unless you transfer sponsorship from husband to last company, and in that way, your company may give you 6 mos ban and labour might give additional 6 mos ban, total of 1 year ban for not completing the years of contract (I doubt on your case since you’re still on husband visa so no worries). I think all you need to pay is for the cancellation of your labour card since last company paid for the processing, since your resigned, bear the consequences from it. Lastly, if labour gives you a 6 month automatic ban, you can talk with your new company to lift the ban by paying through monthly deduction from your salary with the amount of your choice (only an option or the company might bear everything if they need you right away). The good thing about having a wife visa or husband visa is you can transfer from one company to another without stressing yourself about getting NOC from previous employer, but about the bans (correct me if I’m wrong), it’s not because you’re in husband or wife visa, you’re not exempted from getting one.

1.my last company didinot ask me to pay labor card processing amount
2.last company is only saying that you will get ban of 6 mnth from labour department which is automatic ban and company is not related with this (but when I checked with labor department they said its not applicable in my case I will not get the ban.I think my previous company might be not aware about the process and they try to scared me

Hi Ann, what labour advised you is correct (you wont get ban). Last company is just scaring you, they know the process (not unless your PRO is new). Read your contract, one line will say there that you will pay for any dues on processing of visa/labour card if in case you resigned before the contract ends. Tell your last company “it’s ok if labour bans me, just cancel my visa so I can move on”. Get the cancellation letter from last company, no need even to get an NOC coz your husband can give you that. FYI: there are 2 types of ban, 1 given by company, 1 given by UAE. Both are 6 months so total is a year. NOC is necessary so next company can reapply for labour card. but if you have UAE ban even if you have NOC, you’re ban from entering UAE so its useless. What your company is telling you is the ban from getting another job within 6 months, but they are just scaring you. Go get your cancellation letter so you can move on. In the end always check with labour dept numerous times.

@ Magie, it depends on how fast your PRO has processed your visa/labour card. Most companies usually don’t process those things withing the first month, so better check with your company.
hello jzerx. i just got a new job from dubai on a freezone area. i have been with the company for less than 2 months and i want to resign for personal reason. I want to know, shall i pay back my employer for the visa that they provided me, if so, how much should i pay them?And do i need to serve a month notice? Or worst scenario, can my employer have the right to not accept my resignation?

If you will transfer to another company within freezone, your visa will be processed to your new company but the labour card will be the same. I have no idea if you will pay them for processing your visa, better check with free zone authorities, alright!

If I join that and if my Labour card is processed by them, But incase if I’m not happy with the job for any reason and wish to change to another company than will i get ban from the employeer? will i get ban from labour? What fines I have to pay?

Hi Sam, don’t let your company or future company transfer the sponsorship from your husband to them, coz if you don’t want the company and didn’t finish the contract due to resignation or termination, the company might give you ban but even so, your husband will give you NOC, thus lifting the ban. It is an advantage to be under your husband’s visa, plus salary package is more compared to sponsored by company. Now for labour ban you’re exempted from having one (pls verify from labour dept too). The only sad thing about being under him is when he is terminated or resigned and he needs to go back to your home country, even if you have the greatest job, you will suffer too, you have to go back with him.

It would also be wise if the next company is not a competitor of the previous company so they can release you in good terms and give you NOC (some freezone companies require this especially if they are located within the freezone area but they are not actually a freezone company, so beware. I dont know about the things that you need to pay your previous company if you resign. I’ve never had that experience yet. Better check with your company for that.

I came to Abu Dhabi in Oct on a visit visa and got a job over here, now i came here again on employment visa but my company is not paying me as agreed as My offer letter was for 5000 Dhms and my owner said that we will give you room separetly. but they didnt give me the room and said that it was not agreed. I dont have any written proof for this. They mentioned 4500 in my labor contract and they said that they will deduct the visa fees (500 monthly)for six months. i was offered to work as Coordinator but they are taking some other works as well like Labor or Helper level, when I refused, then he has stopped my House Allownce which they said before they will give me separately. Now my salary is 4500 in labor contract..I dont want to work in this company anymore as there is no self-respect.. I want to cancel my visa..I would like to know if I cancel my visa after 6 months, my company will not give me NOC even I work 2 years and 11 months. so can I lift up the ban by paying in Ministry?? If I can lift up the ban then how long I can stay in UAE. I need help.. I dont want to work here…Please advise

Hi there! I had got a job & signed the offer letter in the last week of my VV. When I was about to leave the country on the last day of my VV, they called from HR and told me not to leave & that they’d pay over-stay fines. I was thrilled and submitted all my documents, passport to the company the very next day. I started work on Sun since I was told I got the pink 6-month approval visa. However, on the first day of work I realized that it was not at all related to what I studied and expected. And for many other reasons, I told the company that I would not be doing justice to the job if I continued. Since they didn’t have any other opening, I resigned in the probation period.
However I am looking for a new job in the meanwhile.
My queries are as follows:
• There is no policy of immigration ban with my previous employer. But will there be any ban with the labour department? They have not processed any other documents for medical certificate, labour card etc, only the approval visa is there
• They said they will cancel my approval visa and return my passport in one week. How much longer can I usually stay in Dubai after that?
• They rejected my request to issue me with a NOC. How will that affect me when I look for new job?
• If there is a grace period after cancellation of approval visa, can I look for new job and I get it, what complications will I have or will the new company have in getting a new visa?
Any other additional information that you think might be helpful would be greatly appreciated.

I understand there is a automatic 6 mos labor ban..But My question is this-Can my Company give me a 2 yr labour ban if i transfer to the same kind of biz..even if there are no conditions stated like that on my labor contract?…Pls Advise..thanks

Go to Fujeirah to raise your complaints and before you go home, make sure that you get all your dues from that company, and will be settled by the help of Labour dept in Fujeirah. I see you have a strong case against them. If you got proof that you served 2 months extending to 3 months without them getting a replacement for you after giving them your resignation letter, it's their fault and loss.File a case, the law is in your side. Now if they asked you why you're working in Sharjah instead of Fujeirah, let your company answer that for you, tell them you're just following management orders, but if it wasn't contained in your contract that you'll be relocated, Labour might question you as well why you let them relocate you. Now the company you're complaining is not in Fujeirah so they might tell you to file a case in Sharjah, so be it..God bless.

So whether you have visit visa for each, who cares, that is advantageous to your side coz you can go from one country to another, as long as they’re valid. But from UAE, if you want to go back to Oman, since the visa before wasn’t cancelled, they might deny you of new visa. We’re talking here about working slash residence visa ayt? So long..

Just to be in a safer side of the road. Ayt! On the contrary, if you’re an adventurer and don’t have the reason to go back to Oman for employment, then why bother?

Hi Vivek, ask it amicably with your current employer. If the next company is not a competitor of the previous, it would be better, then explain to them. Tell them further that you can’t live with the current situation that’s why you want to leave the company. If they don’t want you to resign, ask help from Labour dept.

You should have something from them since you didn’t cause your termination from them but they are the reason why you’re terminated. Hi Amit, sometimes, the company is so slow in getting labour card for their employees, yours might be on the way, ask for the number (i forgot what that number is so you can check online if they submitted an application for you and thus check the status). If they can’t give you a direct answer, get out.

Let your manager terminate you and she should give you reasons why she is terminating you, on the paper, it should be documented. If that happens, you will receive your dues, why? it isn’t you who bridged the contract but they did. Since this is not what happened, bear the consequences of resigning. You didn’t finish your contract so bans might be imposed on you. With regard to the status of your visa transfer without you signing any document that your company transferred your visa from free zone to them, ask the help of other PROs around or better yet, labour dept.

Hi Gopa, sorry to say but that company might not give you employment visa at all. Think of the people already in Dubai looking for job vs you who are not in Dubai: it’s high. So better look for another company, or an agency who can direct you to employers in Dubai for years. Good luck!

Posted by jv at May 7, 2010, 1:31 pmJV, the company has the right to stop your employment even if you’re still in probationary period with reasons of which are valid, though a company shouldn’t hold the passport of their employees in any way, illegal un. Ask in a friendly manner not to cancel your employment visa yet so you still have at least a month to look for another job. I think if a company terminates you, they usually give their employees a month to look for another job before they cancels the visa (verify from Labour dept). (option2) If not, go to any travel agency and ask them to print a fake return ticket to Phils, just so you can get your passport back, and then you can move on and apply for a visit visa for the meantime. But that would be too risky and expensive.

My company is under the ministry of immigration therefore I do not have a labour card. recently, they have been persuading me to give my paspport as per company rules, and as I handle money. I’m not willing to give my passport in. I’d rather refer you to “ask the law” of gulf news, as I’ve never have stories like you working under immigration but don’t have labour card??? Usually it should be illegal for the company to keep one’s passport, but better yet ask the authorities.

Your employment with them doesn’t follow what’s on the employment visa but on the contract’s start-end date signed. It is their fault if they let you start without employment visa first. Don’t be confused. Follow what’s on the labour contract, this has more weight than employment visa. They are just making excuses so they can use you more.

From the date i was working with that company in dubai , bcoz of my family issues i forced to decided to came back to India by October 2008 without canceling residence visa. After that i couldn’t go back.my residence visa expiry date on 23/08/2011 only.
Now i want to go to Dubai for 15 days with visit or tourist visa, can i apply for a short time visa ,is it possible to enter in dubai.

If your company terminated your service without finishing your contract, you should get all your dues, because you’re not the one who bridged the contract, its them, whether it is because of global crisis, at least you should be given your dues. With regard to NOC, if they terminated you, your company should give you at least a month to settle your stay here in Dubai by issuing NOC (not unless your company is heartless, they wont give a damn). Your NOC will act on lifting your 6 month ban so dont worry about the ban anymore. Hope we’re clear about this and goodluck.

1. They have proof that you resigned and they didnt terminated you if Labour dept will ask them. (if you decided to ask help from Labour due to injustice of not getting all your dues from them)
2. So not to give all your dues because you resigned.
Rachel, it’s mandatory that a company will give everything including a return ticket to country of origin if they terminated an employee. Rule of thumb, if you resigned your lost (you pay all the bills). If they terminated you, you win (they will compensate you even more).

Now, if that company is trustworthy, you can give your resignation letter but firmly ask them to give you in return:
1. All your dues
2. NOC
3. Not to cancel your employment visa until you find another employer to transfer into
on the day that you give the signed resignation letter. Meaning, dont agree if they say we will give it to you next time you visit.

Posted by suresh at May 27, 2010, 1:39 pmHi Suresh, resigning out of vacation is not desirable, you might lose your end-of-service gratuity, specially you worked in that company for 3 years. Forget about the validity of contract & working permit coz every country is different. Previous company might ask (I dont know) to ban you from entering another GCC country if they feel you didn’t resign properly or give back what they own. It would still be best to settle your account from Qatar before going to other country. best of luck for you!

My job VISA was valid tilll july 2009. On june 2008, i had to come back to India on emergency leave and unfortunately could not go back. I send a resignation email to my employer so that they could appoint a new person in my place. I did not get any reply from them. However, soon after I came to know that they have appointed a new person in my place. Now, I have a job offer in oman for a different ttrading company. and would be travelling by end of next month. I want to know, if there would be any issue with the immigration system in india or Oman during my travel. Will my earlier expired oman visa make any problem to my new visa. Will I be send back from the airport itself since, I don’t have any cancellation stamped in my passport for the old visa. Pls help me how to solve these issues. There might be some problem with getting new visa for new company in Oman but there should not be any problem with Indian immigration. Better yet is your new company to start processing your visa before you go to Oman so they know the status of your previous visa. Then follow through. Cheers!

If that’s the case, you company didn’t process any papers yet thus no pending applications in labour dept for your labour card. But check intensely with your PRO if they magically submitted documents to labour dept even without your signature, even without labour contract. or check with labour dept itself. Dont resign yet so you can still get your salary. Secondly, if your visa was transferred from husband to employment and that’s under process, you will pay for the fee, and you need to get NOC from them coz if not, you’ll get 6months ban once you resigned. But if your visa is still under husband’s, your husband will be giving you NOC and not your company simply because your husband is your sponsor and not the company thus neglecting any ban.

Is it right for me to pay the visa and NOC? and do they have the right not to allow me even if i want to leave the co. coz our salary is very small. and to think its not that big amount it is always delayed. Every company has the right to give or not to give NOC to employees, you cannot ask Labour to ask the company to give one. You can always ask help from labour and report what the company is doing to all their employees. About the ban, if labour finds out that you brigded the contract with no valid reason, they might give you 6 mos ban, plus your company might request additional 6 mos ban from labour to be imposed on you total 1yr.

i am working under a RAK free zone and a sponser of my visa is RAK investment authority. I have completed 10 months of working in RAK FZC and now i got a new offer in Abu dhabi with a salary double then my privious. so I want to know if i resigned from present employer then my employer will imposed any ban on me. How can I lift the banned if such think happens? The another think i want to disclose is they have appointed me for indian business on indian appointment letter, after some month they called me here for some work and stamped the employment visa on my passport even i have not signed the contract as they are converting my indian salary in to AED, thet’s the reson i have not signed the contract so i want to asked wether in this case they banned me to work in another company/in UAE. ( I have not signed the contract till date, its an Unlimited contract i am working for) Please advice.

I signed a letter of employment to work for a company in Dubai back in November 2009. On the offer of employment letter it stated that I would commence work within 3 months and I am still waiting to start work! They have told me that they are waiting for labour approval etc, etc. Apparently they put their visas through in batches and mine will be placed in the next batch. When I questioned the company I was told that if I didn’t like it I could find work elsewhere. Iam confused and don’t know what to do. This is a big company in the health and fitness industry. Where do I stand legally with this?

Rule of thumb here: if the company fires you within the contract period, they will give you all your rights. If you resigned, you will pay the company.

But I’m still trying to get a new job for me in Dubai. What if I don’t leave the country before 1st of July? I heard I would be paying a fine AED 25 per day for some time,like 10 more days. But I need 1 more month,at least till 1st of Aug to find here another job. Can the company I resigned from make any troubles for me like a fine, of police report for overstaying the grace period for 1 month? and what fine should I pay?

Your company is only loosing you and their money in processing your visa that’s why they’re threatening you. Tell your company that you will pay for whatever fees you owe them in return they will give NOC (just in case you will land in a non-free zone at least you have one). They shouldn’t hinder you in going to other GCC once your visa is canceled.

He lodged a complaint to MOL, which we attended and the case was dismissed and he was told to take the matter to court, which he has now done. Will he get an automatic ban and are we as a company entitled to any compensation once the court decides, that he was in the wrong, his complaint is we have not paid him, but we can prove that we have.

hi, i have a pinoy friend in Dubai who has been working as an admin clerk for 6 months or more, however she has not been paid for 2 months now and her employer is holding her passport. She no longer wants to work in Dubai any more and wants to go home. The employer is the sponsor of her visa (AED8000). Please advise on how / what ways she can go about on getting her passport back. I felt what it is like not to be paid for more than 2 months, and at the same time, they are holding my passport. Talk to the management first about the problem, if the company can’t give the salaries, then suggest to give back the passport so that the torture will not be prolonged or else you seek assistance with the authorities. If they will not allow a talk between your friend and the company, file a complaint at Labour Dept.

Check with Freezone if your visa was submitted and it is pending. If it isn’t good for you. There should be no ban. You can use the old visa to walk at Dubai’s land until it’s due. But if it’s pending, the company might give you ban since you didn’t complete your contract with them.
hi good day. i just have some questions that needed answer. a friend of mine Just finished his 3 years contract last july 15 2010 but up to now his company have not yet proceed with the cancellation of his visa. my question is how many days it will take for the ministry of labor to cancel his VISA? and since his visa is already expired and have not been cancelled. he will not PAY any overstaying fine right??
another question is after cancellation of the VISA. How many day is the grace period before he leaves the country? I believe he is planning to OVERSTAY here for 1 month more. HOW MUCH HE NEED TO PAY per day? and WHERE he will need pay this?

Posted by raymond at July 27, 2010, 6:11 amHi Raymond, cancellation of visa will take only minutes. If visa is expired, your company should pay the daily overstay period, not your friend. Usually after the cancellation of visa, it would take a month, but in your case, since you are overstaying, that I’m not certain. He needs to exit so he can be issued visit visa again. You wont have 6 months ban since you finished your contract.

My husband’s company informed us that he needs to go to Abu Dhabi first to complete the resident visa process (which takes up to 3 weeks). Only after this time, the process for my resident visa (as wife) will be started. Is it possible I get a visit visa to follow my husband and wait in Abu Dhabi the completion of my resident visa process? I don’t think is appropriated waiting more than a month to be eligible to join my husband.

As far as I know and checked with the labor, I only need to pay the labor card fees only for 1500 aed. I still have 5000aed left salary with them, but they want me to pay 3000aed to cancel my labor card. I told them to give me the breakdown and I will consult first to the labor if it is really needed to pay what they are asking for, but they refused to it. Can I go directly to the labor just to let them know that they are asking me to pay such amount? I’m confused also, Do I have a 6 months ban?

Hi everyone!.. Can someone help me, I was working before with one construction company for 1 year and 7mons, but when the crisis came, i got terminated but they give me a lot of time to find a new job and company to work with. And then I find this new company that I’ve been working now for 4mons. I already have a new visa and PATAKA with this new company but yesterday I was informed by one of the manager that they were terminating me for “poor performance” reason. They also told me that im in probationary period so they can terminate me anytime. They give me 30days to find a new company to work with, but what if I want to go home and cancel my visa to them, am I entitled as per labour to have a plane ticket going beck to my home country that be provided by them and am I also entitled of 1mon salary?.. thanks!

Will i face any legal issues if i chose to opt for the newly offered job ?
Any way around going to a competitor within same free zone. such as going in the intermediate term under my wife’s sponsorship or leave the country for a while or anything else?
I m sure there are loopholes. The last thing I would want to do is to tell my current employer that I m going to a competitor: it’s definitely going to be a reject!
hi i have a doubt. i am on visit visa searching job in dubai. a company has offered me a job and they have applied for a free zone visa which is actualy processsed. But i have only signed on my offer letter i am still in dubai with visit visa. i have better oppurtunity with better pay with another company. will i have any problem getting employment visa or free zone visa if the 2nd company is offering me a job and ready to provide me visa since the earlier company has processed my free zone visa. will i be able to deny the 1st offer and look out the better prospect. please clarify

I am on a unlimited contract and just completed 9 months in this company. The company will not give me the NOC as a result I will get an automatic ban from the Ministry of Labor - UAE.
Can I join this company in RAK if I have a 6 months ban? Will this ban effect if I am getting a job in Freezone?

Please could you advice me on this issue. I have signed a letter of offer at a company in UAE, but din have much idea about the non-competition clause and the limited contract. I have gone through different forums and seems its not the best to sign the non competition clause.

I have a question and would be very grateful if you can help me out..
1. I have a contract of 3 yrs in my company right now, after working with them for 1 1/2 yrs, they have decided to terminate me due to crisis. All the while they knew that my contract is UNLIMITED… but when they gave me the termination letter I asked for a copy of my contract and found out that it is LIMITED.. upon knowing this, they are threatening me not to ask for the 3 MOS. Salary I am entitled with because according to them If i asked for it, they will not issue NOC.
my questions are:
1. if a contract is limited will I be entitled for the 3 mos salary if the company terminates me?
2. will I be getting an NOC from my company if they terminate me whether they like it or not? or it is still up to them???

Posted by mani at January 24, 2011, 8:00 pmHello Sir,I am working in Fujairah from the last 6 and Half years.6 Months before i renew my visa.Due to some reason i cannot continue with this job therefore I give resignation letter on Dec 5th 2010 But till date company didn’t take any favourable action therefore I am forced to file a case in Fujairah Lobour court .Sir I want to know how much chance is there for a favorable judgement and how much time I have to wait for the same.

I am on my husband sponsorship in dubai.. I have joint a company and signd a contract where it was mentioned that if i leave the company i wont be able to work with their competitors for 2 years after leaving the company and the same would be mentioned in my labour contract..
My labour card is under process..
now my problem that if i get a good offer from the competitor.. would it be any problem if i shift? can any such ting be mentioned in labour contract or its just to scare the employees?

I got a job i al ain UAE,the problem i have now is that a had a job in dubai 2 years ago and left without resiging as my father was in critical condition.My labour card is still active for that company.I called the company to cancel my labour card and they said no they dont want to do it ad i have to pay 10 000 AED before they will do anything,because he was angry when i called and said that i wont come back.i just got my visa before i left that company.what do i do now?do i pay the money and hope that they will cancel it?and if they do cancel it,will it be cancelled and ready for me to make my new company visa or will they give me a ban after they cancel it?

My problem is that I have also secured a position in a achool in Dubai too for September - it is something a dearly want and is where I originally wanted to go to first - will there be implications/ban when i go to apply for my visa in Dubai?

I am on a limited contract,freezone company under DMCC. My employer terminated me after serving with them for 4 months , without giving me termination letter so by end of february i was told that i need to leave the office and start looking for a job. When i am asking for my salary she said she’s not goin to give me because i need to pay her for the visa expenses amounting 5900 dirhams. SO she held my salary 2850 plus 300 that she cut from my 2 months salary for the visa security total of 3150, So she told me that i still have a balance of 2,700 AED and when i am fully paid with that amount then thats the time that she will give me my passport and she will cancell my employment visa under her sponsorship.While i knew that according to UAE Labor law, i am not entitled to pay her when she’s the one who terminated me in the service.I already filed a complaint in DMCC 3 weeks back but still i got no reply from them, when i called them the guy who is holding my complaint is just telling me that they will call the employer. Now i don’t know how long do i need to wait for their action, because the reason why i asked for their help was because i know that they will be the one to mediate when there is a dispute between the employee and the employer, and they will always be there to help and protect the employees.
Now i need your advise if the labor ministry can help me with this or just die waiting for DMCC AUTHORITIES TO TAKE LEGAL ACTION on this problem.

I got a job in Dubai but had to go back to my home country as my visit visa expired before an EV could be issued to me. I have the EV now but due to some issues with the government from my home country, have not yet been able to leave the country. My visa expires in less than 7 days. What happens if it expires before I get to Dubai? Can I come back on a tourist visa once the EV expires?

hi, I have a query if anyone can help me out.
Six months back I went to UAE (Dubai) on 3 months visit visa and signed an offer letter with one of the company in Dubai. But for some reasons I had to comeback to Karachi (Pakistan) so I informed that company and comeback to Pakistan at the end of his Visit Visa. But unfortunately that company already processed my employement visa. This employment visa has already been expired (according to Labour Dept Dubai). Recently I applied for visit visa (dubai) again but it was refused from immigration Dept. and immigration dept. said that first cancel this Expired Employment Visa then I can apply for visit visa.
Therefore I called to that company to do cancel this expired employment visa, but they denied to cancel it. Even I said that if you have any vacancy or anything else so I can join your company but they simply denied me.
Now I am in Pakistan, so how can I process the cancellation of this expired employment visa, when the employer is not ready to cancel it?? so I can get the visit visa. Thanks.
